These terms cover this website. They are not the terms for any app. Each app has its own terms of service, published with that app and at apppolicies.net. Where the two differ for an app, the app's own terms govern that app.
1. Acceptance
By accessing indrevo.com you agree to these terms. If you do not agree to them, please do not use the site. The site is operated by Twisted Lunacy (ABN 21 979 134 918), trading as Indrevo, from New South Wales, Australia.
2. What this site is
Indrevo is a catalogue and shopfront for apps built by our own studio. The site describes those apps, links to them, and lets you join a waitlist to be told when one launches.
Nothing on this site is currently an offer to sell. No purchase can be made through indrevo.com today. Where an app later becomes available, it will be sold either through the Apple App Store or Google Play under their terms, or directly by us under terms published with that app.
3. Accuracy of what you read here
We describe apps that are in active development. Features, pricing, availability dates and distribution channels stated on this site are our current intention and may change, and an app described here may never ship. Where a page says an app is launching, in early access, or not yet open, that is a statement about its status at the time of writing and not a promise of a date.
4. Acceptable use
You may read this site, link to it, and quote reasonable extracts with attribution. You must not:
- use the site for any unlawful purpose, or in breach of any applicable law;
- attempt to gain unauthorised access to the site, its host, or any connected system;
- interfere with the site's operation, including by automated scraping at a rate that degrades service for others;
- submit another person's personal information to the waitlist form; or
- misrepresent your affiliation with us.
5. Intellectual property
The content of this site — its text, design, logos, marks and the apps described — is owned by us or licensed to us, and is protected by copyright and trade mark law. Using the site does not transfer any of those rights to you. Third-party names and marks mentioned on the site belong to their respective owners.
6. Links to other sites
Each app links to its own website. Those are operated by us but governed by that app's own terms and privacy policy. The site also links to third-party sites we do not control, and we are not responsible for their content or practices.
7. Disclaimer of warranties
To the maximum extent permitted by law, this website is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, timely, secure or error-free, or that any information on it is complete or current.
8. Limitation of liability
To the maximum extent permitted by applicable law, Twisted Lunacy (ABN 21 979 134 918) and its affiliates, officers, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use, goodwill or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the site; (b) any conduct or content of any third party on the site; (c) any content obtained from the site; or (d) unauthorised access, use or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence) or any other legal theory, and whether or not we have been informed of the possibility of such damage.
In no event shall our total aggregate liability exceed the greater of (i) the amount you have paid us in the twelve months preceding the claim, or (ii) one hundred Australian dollars (AUD $100).
Your rights under Australian Consumer Law are not affected. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies to you under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the maximum extent the law permits. Some jurisdictions do not allow certain exclusions, in which case the clauses above apply only so far as that jurisdiction allows.
9. Indemnity
You agree to defend, indemnify and hold harmless Twisted Lunacy (ABN 21 979 134 918), its affiliates, licensors and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable legal fees) arising out of or relating to (a) your breach of these terms; (b) your use of the site; (c) your violation of any third-party right, including any intellectual property, publicity, confidentiality, property or privacy right; or (d) your violation of any applicable law or regulation. This obligation survives your ceasing to use the site.
10. Privacy
Our handling of personal information is described in the privacy policy, which forms part of these terms.
11. Changes and availability
We may change these terms at any time by publishing an updated version on this page with a new effective date. Continuing to use the site after that constitutes acceptance. We may also change, suspend or withdraw the site or any part of it without notice.
12. Governing law and disputes
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State. If a dispute arises, we ask that you contact us first at hello@indrevo.com so we can try to resolve it directly; both parties agree to attempt good-faith resolution, including mediation where appropriate, before starting proceedings.
13. Severability and entire agreement
If any provision of these terms is found to be invalid or unenforceable, that provision is severed and the remainder continues in force. These terms, together with the privacy policy and the refunds policy, are the entire agreement between you and us in relation to this website.
